Estate Agent Referral Scheme: Terms and Conditions

1. The Terms govern the Estate Agent Referral Scheme, and the relationship between you and McCarthy & Stone Retirement Lifestyles Limited, and its subsidiaries (McCarthy Stone).
2. To receive £5,000 commission fee you must refer someone (Referee), who then goes on to buy a new apartment from McCarthy Stone.
3. To make a referral contact the Sales Consultant at the development, giving the name and contact details of the Referee.
4. McCarthy Stone reserves the right to claim back any referral fee applied through Community Referral Scheme if fraud or abuse is suspected or a referral fee is paid in error.
5. A referral will only qualify for Estate Agent Referral Scheme if the Referee reserves a property within 90 days of the referral and subsequently goes on to complete their purchase.
6. If the Referee is a former resident, or someone who has enquired about McCarthy Stone developments and given us their details before, then you will not be eligible for a referral fee.
7. At the time of the referral, the Referee must not have already been recommended by anyone else.
8. If a Referee completes a purchase a McCarthy Stone employee will contact you to let you know and you must issue a valid VAT invoice, listing the referral fee, development and name of Referee
9. The referral fee will be paid by cheque which will be issued to you within 30 days of the end of the month in which we receive your valid VAT invoice.
10. Referral fees will not be applied retrospectively.
11. By providing us with your contact details you agree that we will use your data to administer the Estate Agent Referral Scheme and that all notices will be issued to you at the address you provide. All notices to McCarthy Stone should be addressed to the Company Secretary, McCarthy Stone, 4th Floor, 100 Holdenhurst Road, Bournemouth, Dorset BH8 8AQ.
12. If you process personal data (as defined in UK and EU Data Protection Regulation) you shall only process that data for McCarthy Stone for the purposes of the Estate Agent Referral Scheme and as instructed by McCarthy Stone. You shall not provide that data to any third party (except as required at law) and you use appropriate technical and organisational measures to protect the personal data against unauthorised or unlawful processing and against accidental loss, destruction, damage, alteration or disclosure;
13. You warrant that you are not in breach of any legislation, guidelines or regulations that apply to your business, by accepting a referral fee and that you indemnify McCarthy Stone for any losses, damages, costs or expenses it may suffer should you breach this term.
14. Whilst you participate in the Estate Agent Referral Scheme you will not act, or fail to act, in a manner that McCarthy Stone considers brings McCarthy Stone’s reputation into disrepute.
15. McCarthy Stone reserves the right to terminate your participation in the scheme immediately if it considers you have breached, or are likely to breach, the Terms, or at any time on giving not less than 30 days written notice to you. Once the business partner has signed the Estate Agent Referral Scheme Registration Form then any further communication can refer to these terms and conditions by referring back to this Estate Agent Referral Scheme Registration Form.
