A McCarthy & Stone initiative to connect people aged 60 and over with similar individuals looking for companionship, via a sign-up pen pals scheme.  

By signing up to the pen pals scheme (the “Promotion”) you (the “participant”) agree to be bound by these terms and conditions. Any information or instructions published by the Promoter about the Promotion on www.mccarthyandstone.co.uk, www.facebook.com/mccarthystone and https://twitter.com/McCarthyStone form part of these terms and conditions.

THE PROMOTER

The Promoter of this Promotion is McCarthy & Stone Retirement Lifestyles Ltd (4th floor, 100 Holdenhurst Road, Bournemouth, Dorset, BH8 8AQ), and the Promoter shall not be liable for any interruption to this Promotion whether due to force majeure or other factors beyond the Promoter’s control.

ENTRY ELIGIBILITY

1.           The Promotion is open to residents of Great Britain (England, Scotland and Wales) aged 60+           

HOW TO ENTER & THE DEADLINE FOR ENTRIES

2.            Applications will be accepted from 00:01 on Tuesday 22nd January, 2019.

3.            The closing date for applications is 00:01 on Sunday 31st March 2019. Applications received after the Period will not be eligible for entry.

4.            Applications can be made by the Participant only. Participants should either (1) complete the application form online on the McCarthy & Stone website: https://www.mccarthyandstone.co.uk/pen-pals/  (2) print the form from the McCarthy & Stone website, and on completing the form post it to the following address:  FAO McCarthy & Stone team, McCann Central, Highlands Road, Solihull, B90 4WE (3) download the form from the McCarthy & Stone website, and on completing the form email it to: penpals@mccann.com (4) request an application form to be posted to them by calling McCarthy & Stone on: 08008100089 and providing their name and address.

5.           Each Participant will be asked to provide a 100 word summary to describe themselves as part of their application form. Each Participant accepts that this summary will be shared with their prospective pen pal as part of the ‘matching’ process (see clause 10).

6.            Participants may only apply once. Duplicate applications will be removed.

7.           No purchase or further action is necessary to enter this Promotion.

8.            No responsibility is accepted by the Promoter for lost, delayed or damaged data which occurs during any communication or transmission of applications.

MATCHING OF PEN PALS

9.           Application forms will be considered by the Promoter and independently ‘matched’ by a third party agency (“McCann”), in its sole discretion, to other applications based on shared hobbies and interests.

10.         McCann reserves the right to telephone each Participant during the ‘matching’ process to clarify any details provided in the application.                                   

11.        Once a ‘match’ has been identified, McCann will write to both Participants to introduce them as pen pals, nominating one Participant to start the initial exchange by providing the other’s full postal address. The Participant will be expected to write to their pen pal within an allocated time of three weeks from the date of receiving their introductory letter.   

12.          In the event that a Participant is unreachable, ineligible, or fails to accept their offer of pen pal in the time required, the Promoter reserves the right to make this offer to any other participant of the Promotion.  

13.          The Provider gives no guarantee in relation to this Promotion, and cannot be held liable for any injury, loss or damage of any kind.

14.          The Promoter reserves the right to publish the names and towns (but not full addresses) of all Participants who are ‘matched’ with a pen pal.

15.          The Promoter will have no liability in relation to the conduct of the Participants, nor in connection with any circumstances outside its control with respect to the Participant’s exchanges once they are ‘matched’ as pen pals.

16.          The Promoter reserves the rights to vary these terms and conditions or cancel the Promotion at any stage in the event of circumstances arising beyond its control.

17.          By entering the Promotion, Participants will be deemed to be bound by and have accepted these terms and conditions

DISQUALIFICATION

18.          The Promoter reserves the right, at its absolute discretion, to disqualify Participants who it considers to have not complied with any of these terms and conditions; or any Participant who it reasonably believes has interfered with the fair running of this Promotion.

PRIVACY AND DATA PROTECTION

19.         The Promoter may use and share with McCann any personal information submitted by the Participant in the proper administration of their application only. The participant hereby consents to such personal information being used for this purpose only and confirms that it agrees with the Promoter’s privacy policy available at www.mccarthyandstone.co.uk. The participant may withdraw consent to such use of personal information by writing to the Promoter or by using the opt-out process outlined in the Promoter’s privacy policy.

20.         Other than as set out in these terms and conditions or for the purposes of operating the Promotion, the details and information provided by the Participant when applying to the scheme will not be used for any promotional purpose, nor shall they be passed to any third party unless the participant has actively opted-in to such by expressing their communication preferences via the entry form.

21.         Data will be held for the duration of the Promotion and for 12 months post Promotion should McCann wish to seek approval from the Participants for publicity purposes related to the Promotion only, or if any further follow-ups are deemed necessary by McCann.

JURISDICTION/APPLICABLE LAW

22.          This Promotion will be governed by and construed in accordance with the laws of England and Wales. By participating the Participant agrees that any and all disputes regarding this competition will be subject to the jurisdiction of the English courts.
